Area of application
The following terms and conditions apply to all services provided by TAXI WARSHEEK, in particular for the occasional passenger transport, rental car traffic and excursions by passenger car. They also apply to all future business, even if they are not expressly agreed again. our conditions are considered binding and accepted. Deviations from our terms and conditions are only effective by a written confirmation on our part.
Order placement and contract
The company TAXI WARSHEEK offers are non-binding. Orders and acceptance declarations always require written confirmation from us to be legally effective. Furthermore, the client commits himself to all relevant factors for the execution of the order, such as: Name and address of the client, place of order, date, number of persons, number of pieces of luggage to be notified.
Information and data must be available to TAXI WARSHEEK within one day and in definitive, binding form. Furthermore, TAXI WARSHEEK is not obliged to check the provided data or documents for their correctness. Amendments, modifications or additional agreements also require written confirmation.
TAXI WARSHEEK confirm the order, usually immediately, but no later than within 24 hours. A contract also concluds that TAXI WARSHEEK actually provides the contracted services.
Booking via the online booking form is legally binding, but always requires the written confirmation of TAXI WARSHEEK.
Prices
Unless otherwise agreed, the current price quotation from TAXI WARSHEEK is always valid. Additional services are charged separately. The prices, unless otherwise agreed, exclude the incidental costs incurred in the context of the order.
The company TAXI WARSHEEK adheres to the prices given in its offer 90 days bound, beyond that, it requires a new agreement.
Your luggage
The travel price includes the transport of the so-called free luggage. The free baggage allowance is per person
• for hand luggage 1 piece (dimensions 85 cm x 55 cm x 30 cm) and
• for luggage 1 piece.
Children under the age of 2 are entitled to free baggage
Excess baggage:
As so-called excess baggage, baggage exceeding the free baggage allowance shall be considered as special baggage such as: bicycles, sports equipment, weapons, animals, etc. If you want to transport special and / or excess baggage, you must register this with us when booking, because the loading capacity of the vehicle beyond the free baggage allowance is limited.
The decision-making basis for taking along special baggage is above all the available capacity and possibly safety aspects.
We reserve the right to refuse the carriage of the special / excess luggage if the loading capacity is exceeded. If necessary, we will contact you on time.
The transport of one (1) wheelchair per disabled passenger is permitted and free of charge, if notified at the time of booking. The refusal remains reserved due to lack of space capacity. The same applies to the transport of guide dogs in the passenger cabin.
Terms of payment
The payments are due immediately upon receipt of the invoice. The invoices are payable without deductions, depending on the agreement, either in cash or by bank transfer to the bank account specified in the invoice. If the contractual partner is in default, TAXI WARSHEEK is entitled to charge the date interest at the rate of 12% per month for outstanding invoices.
Prepayment or cash in the car are also allowed, advance payment for new customers from abroad is also allowed. Credit cards such as Master, Visa Card and American Express are also acceptable. In the case of an on-board credit card of the customer in the car, the payment can also be made directly in the car after completion of the driving order. The payment shall be deemed made when TAXI WARSHEEK can dispose of the requested and invoiced amount. In the event that the counterparty fails to meet its payment obligations, or if circumstances become known to us that the creditworthiness is in question, the company TAXI WARSHEEK is entitled to call in the entire remaining debt and to demand advance payments or securities. Furthermore, the TAXI WARSHEEK company is entitled to withdraw from all contracts in the event of default of the customer.
Cancellation
Cancellation up to 5 days before commencement of service is free of charge. In case of cancellation up to 3 working days before commencement of the service, 50% of the agreed total fee will be due. For cancellations up to 24 hours before the start of the course, 100% of the agreed total fee will be due. In case of later cancellations or non-commencement of the journey, the full agreed rental price will be charged (100%).
For the receipt of a written cancellation the date of receipt of the cancellation notice with us is valid.
Any special expenses incurred by one of our partners and included in the rental price shall be borne independently of any cancellation by the contractor, as far as a free cancellation can no longer or no longer is carried out on time.
Duties and liability of the customer
The duty of our customers is to behave in our vehicles in the manner that dictates the safety and the order of the operation, for their own safety, the safety of our driver and the consideration of other persons. For reasons of safety, the instructions of the chauffeur are always to be obeyed. In the event of non-contractual handling of the vehicle, the contract can be terminated with immediate effect, as far as the guest does not react to a warning. In this case, the termination of the contract does not require a separate notification and the company TAXI WARSHEEK still retains the full compensation claim for the entire agreed duration of the contract. This does not affect the claim for compensation for damage caused by non-contractual handling of the vehicle. Damage to the vehicles or other damage must be compensated by the causer or our contractual partner. If the causer and our contractor are not identical, both are liable as the total debtor. The liability also exists if the client is not at fault. For cleaning, fees are charged separately.
Our liability
Our contractual liability based on the transport order is limited to damage which has been proven to be caused by us, at least grossly negligent. Our liability for other damages is excluded.
Contract and transport exclusion
The subject matter of the contract is the transport of persons subject to authorization TAXI WARSHEEK reserves the right to exclude persons from the transport who poses a risk to safety and order, do not comply with the instructions of the chauffeur or willfully or grossly negligently damage or damage the vehicle.
Jurisdiction, choice of law, written form requirements
For these business relationships and the entire legal relationship between the TAXI WARSHEEK company and the contracting party, the Austrian law shall be applied. The exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is the provincial capital of Salzburg, even if the customer has its place of jurisdiction in another EU member state. If the customer is a businessman, a legal entity under public law or a special fund under public law, the court of jurisdiction is the court having jurisdiction over the registered office of TAXI WARSHEEK, and the claimant is entitled to use the client of his choice at the court having jurisdiction over its seat. Due to international business relations, the present conditions are also found on the English homepage of TAXI WARSHEEK, translated into English. In the case of deviations in the content of the English translation from the original German text, only the version of the original German text applies.
Damage to the baggage:
TAXI WARSHEEK is only liable for any damage to baggage caused during the journeys it has made and for which a valid contract of transport exists. Liability for loss or damage of baggage is limited, so we recommend that you take out a baggage insurance.
Delayed arrival
Our departure times are set so that you have enough time to check in at the airport. But even with careful organization, we can not guarantee compliance with the timetables. Especially because of heavy traffic, congestion, accidents, overloading of airports, diversions, delayed border clearance etc. delays can occur. In all these cases we are not liable, especially not for the flights.
We strongly advise you to consider possible delays in your travel planning.
Smoking forbidden
Unless otherwise stated, all trips with TAXI WARSHEEK are non-smoking
Claims for denied boarding
If the transport is not carried out or delayed for reasons for which TAXI WARSHEEK is responsible, the duty of replacement of TAXI WARSHEEK is limited to the reimbursement of the fare. Any further liability of TAXI WARSHEEK is excluded
Salvatorian clause
Should one or more clauses of these General Terms and Conditions of Carriage be ineffective, this shall not affect the validity of the remaining clauses.
Insurance
We recommend that you provide supplementary insurance coverage, such as Baggage insurance, cancellation insurance, travel accident insurance, etc.
